Identity Theft and Criminal Impersonation Lawyer in Denver: Woman Caught Stealing an Identity on Christmas

Posted by Unknown | Jan 04, 2016 | 0 Comments

According to the news, an 18-year-old girl allegedly pretended to be her friend after taking her friend's driver's license. Authorities learned of the incident when the girl who owned the license told them her name was in a newspaper for a drunk driving arrest on Christmas. The owner of the license alleged she was home all day on Christmas and was never arrested. Authorities later identified the girl who stole her friend's driver's license.  The alleged victim said the arrested woman drank alcohol at her family's home before driving on Christmas and getting pulled over. In Douglas and Jefferson County, Colorado, the 18-year-old could be charged with Identity Theft and Criminal Impersonation – both Colorado Felony charges.

Identity Theft Lawyer in Adams County, Colorado

Identity Theft, C.R.S. 18-5-902, is charged in Adams and Arapahoe County in many ways. As it applies to this news story, Identity Theft can be charged whenever someone knowingly uses the personal identifying information, financial identifying information, or financial device of another without permission or lawful authority with intent to obtain cash, credit, property, services or any other thing of value or to make a financial payment. Since the 18-year-old girl allegedly possessed a driver's license of another (which is considered personal identifying information) without permission or lawful authority, she could be charged with Identity Theft. Adams County prosecutors would also have to prove she possessed the driver's license with intent to obtain cash, credit, property, services or any other thing of value, or that she intended to make a financial payment. In Colorado, Identity Theft is a class 4 felony.

Jefferson County Criminal Impersonation Attorney

Criminal Impersonation is another crime this young woman may be facing. Defined at C.R.S. 18-5-113, this crime seeks to prevent people from pretending to be another person, who in that capacity sign a legal document, marry someone, file a legal document with a government agency, subject someone else to civil or criminal penalties, or unlawfully try to obtain a benefit for himself or another. This crime is charged as a Class 6 felony, resulting in a possible DOC prison sentence.  Since the woman signed booking papers at the jail and used the friend's name related to a crime, it will likely be charged.
