The Douglas and Arapahoe County, Colorado law definition of Sexual Exploitation of a Child, as it relates to possession or distribution – C.R.S. 18-6-403(3)(b.5) and (c) – is:
“(3) A person commits sexual exploitation of a child if, for any purpose, he or she knowingly:
(b.5) Possesses or controls any sexually exploitative material for any purpose; or
(c) Possesses with the intent to deal in, sell, or distribute, including but not limited to distributing through digital or electronic means, any sexually exploitative material;”
Downloading child pornography is enough to get the possession charge, but when those files are available to share where others can download the images you have, then a charge under the distribution subsection will likely be added.
Sentence for Possession or Distribution of Child Pornography in Jefferson and Adams County
Sexual Exploitation of Children can be charged as a class 3, class 4, or class 5 felony depending on the subsection a person is charged under. Possessing Images of Child Pornography is a class 5 felony, unless you possess more than 20 different images or videos, in which case it is a class 4 felony. A Sexual Exploitation of Children charge for distributing images is a class 3 felony. A charge for Sexual Exploitation of a Child is a sex offense no matter what subsection it is charged under and a conviction will require registration as a sex offender.
