Unlawful Purchase of a Firearm

Unlawful purchase of a firearm in Douglas, Jefferson, and Arapahoe County is an offense that includes buying or acquiring a gun for someone who isn't permitted to have one. Colorado Unlawful Purchase of a Firearm

Colorado's unlawful firearm purchase law prohibits buying a gun intending to give it to a person who can't legally possess weapons. CRS 18-12-111 addresses the specific elements of this crime. You commit unlawful purchase of firearms in Castle Rock, Lakewood, or Aurora if you:

  • knowingly purchase or obtain a firearm,
  • on behalf of another or intending to transfer to another,
  • who is in ineligible to possess firearms

It is important to note that this applies to supplying a gun to those you know or reasonably should know can't possess one. If you had no idea the other person lacks gun rights, you haven't committed unlawful purchase of a firearm.

How Serious is Unlawful Firearm Purchase in Colorado?

Each case of unlawfully purchasing a gun is different. Penalties for a conviction won't always be the same. As a class 4 felony, defendants in these cases face:

  • a prison sentence of 2 - 6 years,
  • fines of $2K - $500K,
  • 3 years of parole 

 Additionally, defendants may have to forfeit the purchased / obtained firearms as well.
