The shoplifter would likely face charges of Theft, C.R.S. 18-4-401, for obtaining, retaining, or exercising control over the Oral B replacement heads (an item of value) without authorization. And, the shoplifter likely intended to deprive Walgreens of the item's use since he ran out of the store with the item. Theft can be charged in Denver and Adams County as a petty offense, misdemeanor or felony depending on the value of the item. It can be charged as a class 1 petty offense to even a class 2 felony in Colorado.
